The son is positive for Covid19: can you stay home from work?
Complete guide to all the cases that can arise when a child attends a school with positive cases, or if the child himself is positive for Covid19. Measures envisaged by Legislative Decree no. 111/2020 for absences from work in case of quarantine of student children.
The start of school represents a real challenge for working parents struggling with the return of their children to school and the management of any absences .
The Government has recently intervened on the issue with new operational guidelines for the management of cases and outbreaks of SARS-COV-2 in schools and childcare services and has also temporarily regulated smart working until 31 December 2020 and extraordinary leave for parents during the mandatory quarantine period of the cohabiting child due to school contacts.
What happens if a suspicious case shows up at school?
First of all, while waiting for the outcome of the swab, it is no longer expected that the activity of the child’s class will be suspended.
In the event of a positive swab, the COVID-19 school contact person must provide the Prevention Department (Asl) with the list of classmates, as well as the teachers of the confirmed case who have been in contact in the 48 hours preceding the onset of symptoms, who can be placed in quarantine for 14 days from the date of last contact with the confirmed case.
What working measures are foreseen for parents in case of quarantine of their children?
Article 5, Legislative Decree 111/2020, provides for various solutions that facilitate the working parent during any “school” quarantines.
First of all, it is foreseen the possibility that the parent employee carries out the work performance in agile mode (smart working) for all or part of the period corresponding to the duration of the quarantine of the cohabiting child, under the age of 14.
In the only cases in which the work performance cannot be carried out in agile mode, one of the parents , alternatively to the other, can abstain from work for all or part of the period corresponding to the duration of the child’s quarantine. For the periods of leave used, instead of the salary, an indemnity equal to 50% of the salary paid by INPS is recognized upon request on the institutional website.
