I leave anonymously: this is how it works
It is important to remember that giving birth anonymously is a right enshrined in Italian law . In fact (according to Presidential Decree 396/2000, art. 30 , paragraph 2) the law allows the mother not to recognize the child and to leave him in the hospital where he was born , so that assistance and also his legal protection is ensured” . In this case, the declaration of birth can be made by a person other than the mother .
According to Presidential Decree 396/2000, art. 30 , paragraph 1: “The declaration of birth is made by one of the parents, by a special attorney, or by the doctor or midwife or other person who assisted in the birth, respecting the possible wish of the mother not to be named” . Obviously, the law provides that the confidentiality of the mother’s name must be extremely stringent. Therefore, all professionals , their assistants and public officials in any way involved in the birth of an unrecognized child and in the drafting of the related documents, are required to keep the mother’s name secret.
Childbirth anonymously: what happens to the unrecognized newborn?
The law allows you to adopt a newborn baby who is not recognized by the mother . This is because it recognizes the child’s right to grow up and be educated in a family.
This right is realized through the immediate notification of the situation of abandonment of the unrecognized newborn to the Public Prosecutor’s Office , at the Juvenile Court, so that the adoption procedure can be opened .
It is important to remember that, as in reporting the state of abandonment and in any subsequent communication to the judicial authority, maternal identification data will NEVER be mentioned .
Is a rethink possible?
Normally, a newborn must be recognized within 10 days of birth . Therefore, if the mother has second thoughts, she has this period of time available to decide to take her child back with her.
However, if there are serious and particular reasons that prevent the child from being recognized, the mother can go to the Juvenile Court where the procedure for the adoptability of the newborn has been opened and request a suspension .
This suspension will last a maximum of 2 months , during which the mother will have to have an ongoing relationship with the child .
From what age can the mother recognize the child?
“The recognition can be made by the parent who has reached the age of 16 . In the case of a mother not yet sixteen, therefore unable to be recognized but who wants to take care of the child, the adoptability procedure is also officially suspended until the child reaches the age of 16, provided that the minor, adequately cared for, has an ongoing relationship with the mother ”
I leave anonymously: how long does the right to secrecy last?
The mother’s right to secrecy takes precedence over any other right, request or request. The art. 28 of law 49/2001, which regulates access to information concerning the identity of biological parents, establishes that the adoptee has the right to access information relating to his or her biological parents. With one exception: precisely the case in which the mother has not consented to be named. In fact, if the woman has chosen anonymity, no information can be made available to the adoptee.
